This Act can be adopted by any state or nationally.
The Energy Reliability & Means Testing Act (Simplified Model Policy Version)
Section 1 — Policy Declaration
It is hereby declared that all electricity generation facilities, regardless of technology or fuel source, shall be held to uniform standards of reliability, safety, performance, and accountability prior to construction, interconnection, or operation.
Section 2 — Applicability of Existing Standards
A. All utility-scale solar and wind energy facilities shall be subject to the same regulatory, technical, financial, and operational requirements currently applicable to baseload power generation facilities within the jurisdiction of the State and any relevant regional transmission authority.
B. Such requirements shall include, but are not limited to:
1. Demonstrated reliability and capacity adequacy;
2. Frequency and voltage stability contribution;
3. Interconnection and performance certification;
4. Financial assurance and decommissioning guarantees; and
5. Compliance with all standards for system reliability, safety, and consumer protection.
Section 3 — Enforcement and Oversight
The State Public Service Commission (or equivalent regulatory authority) shall ensure that all renewable energy projects are evaluated under the same reliability and performance criteria used for baseload facilities. No renewable facility shall be approved for siting or grid interconnection unless it meets or exceeds such criteria.
Section 4 — Effective Date
This Act shall take effect ninety (90) days after enactment.
