​A BILL

​To ensure the survival of the United States through the mandatory hardening of the electrical grid against electromagnetic pulse (EMP), geomagnetic disturbance (GMD), and coordinated physical and cyber sabotage.

​SECTION 1. SHORT TITLE.

​This Act may be cited as the “National Defense Grid Resilience Act”.

​SEC. 2. FINDINGS.

​The Congress finds the following:

(1) The United States Bulk-Power System (BPS) is acutely vulnerable to High-Altitude Electromagnetic Pulse (HEMP) events, Geomagnetic Disturbances (GMD), and coordinated kinetic or cyber attacks.

​(2) EXISTENTIAL THREAT.—Expert testimony and the 2025 Annual Threat Assessment indicate that a total national grid collapse would result in a mortality rate exceeding 90 percent within one year due to the loss of food, water, medical infrastructure, and civil order.

​(3) THE TYPHOON OFFENSIVES.—The Republic faces a dual-front offensive from state-sponsored actors:

​VOLT TYPHOON: An active military pre-positioning campaign designed to sabotage critical infrastructure (energy, water, and transportation) during a geopolitical crisis.

​SALT TYPHOON: A "Snowden-level" intelligence breach that has compromised major U.S. telecommunications carriers, hijacked "lawful intercept" (CALEA) systems, and exfiltrated private communications of high-ranking government and military leadership.

​(4) ASYMMETRIC SURVIVABILITY.—The aggressive grid-hardening measures undertaken by the Russian Federation and the People’s Republic of China have created a "resilience gap." By securing their own domestic infrastructure, these adversaries have neutralized the deterrent effect of United States' retaliatory capabilities, thereby increasing the incentive for a first-strike attack.

​(5) LOITERING ASSETS.—The 2023 Chinese balloon incursion and subsequent loitering of powered, steered assets over sensitive installations like Whiteman AFB constitute a "listening tour" designed to map electronic fingerprints for a decapitation strike.

​TITLE I—ORGANIZATION AND MANDATE

​SEC. 101. NATIONAL GRID SECURITY PROGRAM OFFICE.

(a) ESTABLISHMENT.—There is established within the Office of the Secretary of Defense a National Grid Security Program Office (NGSPO).

(b) COMMAND.—The NGSPO shall be headed by a Director, reporting directly to the Under Secretary of Defense for Acquisition and Sustainment.

​SEC. 102. NATIONAL DEFENSE GRID RESILIENCE STANDARD.

(a) ISSUANCE.—The NGSPO shall issue binding National Defense Grid Resilience (NDGR) Standards.

(b) SCOPE.—Such standards shall require the hardening of all Extra-High-Voltage (EHV) transformers and critical control systems against E1, E2, and E3 EMP components.

​TITLE II—CYBER ISOLATION AND COMPLIANCE

​SEC. 201. MANDATORY AIR-GAPPING.

(a) ISOLATION.—All industrial control systems (ICS) and operational technology (OT) managing Critical Electric Infrastructure must be physically isolated (air-gapped) from the public internet.

(b) HARDWARE.—Compliance shall include the mandatory installation of unidirectional data diodes to prevent remote command injection.

​TITLE III—FUNDING AND OVERSIGHT

​SEC. 301. NATIONAL GRID SECURITY FUND.

(a) TRANSFERS.—The Secretary of the Treasury shall transfer $25,000,000,000 annually for fiscal years 2026 through 2029 for hardening activities.

(b) RESTRICTION.—Funds may not be used for consultancy, non-security research, or social initiatives.

​SEC. 302. CITIZENS’ GRID WATCHDOG COMMITTEE.

(a) AUDIT.—A committee of military engineers and transparency advocates shall audit all expenditures.

(b) CLAWBACK.—The Committee shall initiate proceedings to recover misspent funds directly from the personal assets of the contracting firm’s executives.

​TITLE IV—ACCOUNTABILITY AND TRUTH-IN-POWER

​SEC. 401. PERSONAL LIABILITY AND DEBARMENT.

(a) LIABILITY.—Officers and board members of non-compliant utilities shall be held personally liable for criminal negligence in the event of a grid failure.

(b) DEBARMENT.—Individuals found in violation shall be barred for life from serving as directors of any publicly traded company.

​SEC. 402. TITLE IV FUNDING PENALTY.

Any institution of higher education receiving federal research grants that refuses to comply with NGSPO modular standards or accountability mandates shall be ineligible for any federal student loan or grant programs (Title IV funding).

​SEC. 403. MANDATORY PUBLIC SECURITY DISCLOSURE.

(a) ANNUAL NOTICE.—Every electric utility shall include a physical, bold-face insert in every billing statement disclosing:

​(1) Their current grid-hardening "Pass/Fail" status.

​(2) The projected 90% mortality rate associated with a long-term failure in their service area.

(b) ATTESTATION.—This notice must be signed by the CEO under penalty of perjury.

​SEC. 404. FEDERAL SUPREMACY.

Activities certified by the NGSPO shall preempt all state and local zoning, land use, and environmental regulations. No court shall have jurisdiction to stay hardening work.
