Title I — Congressional Findings and Definitions
Sec. 101. Congressional Findings. (Formal purpose statements regarding the need for market reform and stabilization of federal trust funds).
Sec. 102. Definitions. Defines "Qualified Coverage," "Dedicated Health Savings Account," "Healthcare Stipend," and other key terms.
Title II — Consumer Protection and Fair Pricing
Sec. 201. Out-of-Pocket Caps. Individual annual maximum: $2,500. Family annual maximum: $5,000.
Sec. 202. Dedicated Health Savings Account (HSA). All funds contributed to the Dedicated HSA are excluded from Federal and State income taxation.
Sec. 203. Permitted Premium Variation and Rating Limits. Sets internal sub-limits (3:1 Age, 1.5:1 Tobacco, 1.5:1 Geography) and the Absolute Maximum Premium Cap of 6.0 times the lowest possible rate.
Title III — Universal Premium Conversion Mechanism (W-2)
Sec. 301. Stipend and FICA Tax Withholding. The Stipend is subject to the combined 15.3% FICA tax, split between 7.65 percent levied upon the employee and 7.65 percent levied upon the employer.
Title IV — Self-Employed Parity and Tax Integrity (1099)
Sec. 401. Rate Parity for Self-Employed Coverage. Mandates group-equivalent rates for 1099 filers.
Sec. 402. Stipend and Tax Treatment for Self-Employed Individuals. Grants the Above-the-Line Deduction for 100% of the Premium PLUS $5,000 for HSA contributions.
Sec. 403. FICA Tax Integrity. Deduction remains subject to the full 15.3% Self-Employment Tax (SE Tax).
Title V — Market Competition and Cost Containment
Sec. 501. Certificate of Need (CON) Repeal. Mandates state repeal of CON laws.
Sec. 502. Mandatory Price Transparency. Requires real-time, all-inclusive pricing from providers.
Sec. 503. Enforcement Against Non-Compliant Systems. Terminates non-compliant institutions' access to federal student loan/grant programs.
Title VI — Medicare Part B Premium Reduction Mechanism
Sec. 601. Revenue Allocation. All FICA revenue is credited exclusively to the Medicare Part B Premium Reduction Stabilization Account.
Sec. 602. Premium Reduction Standard. The premium is reduced annually to ensure 100% of the new FICA revenue is passed directly to beneficiaries.
Title VII — Social Security Trust Fund Solvency
Sec. 701. Mandatory Restoration of Social Security Trust Fund Solvency. Requires an amount equal to 100% of Medicare Part B General Revenue savings to be transferred to the Social Security Trust Fund.
Title VIII — General Provisions
Sec. 801. Severability. If any provision of this Act... is held invalid, the remainder of this Act... shall not be affected thereby.
Sec. 802. Preemption of State and Local Income Taxation. Prohibits State and local income taxes on contributions/distributions from the Dedicated HSA.
Title IX — Enacting Provisions and Effective Date
Sec. 901. Short Title and Enacting Clause.
(a) Short Title. This Act may be cited as the "Healthcare Market Reform-Plan B Reduction- Social-Security Integrity Act."
(b) Enacting Clause. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled.
Sec. 902. Effective Dates.
(a) General Effective Date. Except as provided in subsection (b), this Act and the amendments made by this Act shall take effect on January 1, 2027.
