Election Integrity Act of 2025
“A Bill to Restore Federal Election Integrity and Enforce the Uniform Election Day Mandate”
SECTION 1. Purpose
To ensure all votes in federal elections are cast and received on a single lawful Election Day, as required by 2 U.S.C. § 7 and 3 U.S.C. § 1; to eliminate unauthorized early voting, mail-in balloting, and post-Election Day tabulation; and to restore public confidence in the integrity and legality of the federal election process.
SECTION 2. Authority
This Act is enacted pursuant to Article I, Section 4 and Article II, Section 1, Clause 4 of the U.S. Constitution, as well as existing statutes 2 U.S.C. § 7 and 3 U.S.C. § 1.
SECTION 3. Amendments to 2 U.S.C. § 7
The following provisions are hereby added to 2 U.S.C. § 7:
1. Election Day Defined
Election Day shall mean the Tuesday next after the first Monday in November. All federal votes must be cast and received on this day.
2. One-Day Voting Only
All voting for federal offices must occur in person on Election Day only, except as permitted in Section 5.
3. No Early Voting
No ballots may be cast or received before Election Day, except for in-person absentee voting under Section 5.
4. No Late Ballots
All ballots must be received by the close of polls on Election Day to be valid.
5. Limited Absentee Voting
Absentee voting shall be limited to: (a) Active duty military and their dependents, (b) U.S. citizens overseas, and (c) No-excuse in-person absentee voting beginning no sooner than 10 days before Election Day. All absentee ballots must be received by the close of polls on Election Day.
6. Mail-In Voting Prohibited
Mail-in voting is prohibited for federal elections, except under UOCAVA rules.
7. Proof of Citizenship Required
All voters in federal elections must provide documented proof of U.S. citizenship. Such as valid US Passport or certified Birth Certificate.
8. Same-Day In-Person Voting
Voters not qualifying under Section 5 sections (a) (b) must vote in person on Election Day at their local precinct or within 10 days of Election day.
9. Paper Ballots Only
Only hand-marked paper ballots shall be used. No electronic ballot casting devices permitted.
10. Hand Counting Required
All federal ballots shall be hand-counted at the precinct level on Election Day.
11. Live Chain-of-Custody Recording
Ballot handling and counting shall be recorded and publicly archived.
12. Ban on Electronic Voting Machines
Electronic voting or tabulation machines are prohibited in federal elections.
13. Ban on Private Contractors
Only government employees and sworn election officials may administer federal elections.
14. Criminal Penalties for Violations
State officials who knowingly violate provisions of this Act shall be subject to federal criminal penalties.
15. Nullification of Unlawful Ballots
Any vote not cast or counted in accordance with this Act shall be deemed null and void.
16. National Election Day Holiday
Election Day shall be a federal public holiday.
17. Precinct-Level Reporting and Certification
Vote totals must be hand-counted and reported by midnight on Election Day to the Secretary of State. Central aggregation is prohibited prior to precinct certification.
18. Preemption of Conflicting State Laws
Any conflicting state or local laws are hereby preempted and void for purposes of federal elections.
SECTION 19. Severability
If any provision of this Act, or its application to any person or circumstance, is held invalid, the remainder of the Act and its applications shall not be affected.
SECTION 20. Effective Date
This Act shall take effect immediately upon enactment and shall apply to all federal elections occurring on or after January 1, 2026.
